ACT’s letter from The Hague Conference to the Ministry of Justice of the Netherlands: HERE
We refer to the article ‚Overseas adoptions rise –for black American children‘ as published on the website of CNN on 17th September 2013.
The article quotes experts as stating that the US laws allow birth mothers to choose the adoptive family of their children.
However, by letter of 11 December 2008, the Secretary of the Permanent Bureau of the Hague Convention informed the Dutch Government that the birth mother’s preference for intercountry adoption cannot override the subsidiarity principle.
We hereby kindly request you to address this issue and to keep us informed of any actions taken.
We also seek your opinion on a related issue: concurrent planning, where in- and out-of-country options are explored simultaneously. Would such a practice be compliant with the subsidiarity principle?
